From the very earliest times of maritime trading, it was appreciated by both traders and carriers alike that maritime risks were a greater hazard than those encountered on land. All aspects of marine insurance incorporating the formation of the Marine Insurance Contract, Insurance Agents and Brokers, Indemnity, Warranties, Causation, Risk as well as Insurable Interests are all to be found in the South African Short-Term Insurance Act 53 of 1998 which would therefore be applicable to Marine Insurance where appropriate.
